Welcome to Kakuma Blogging ("the Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Kakuma Blogging platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Kakuma Blogging is a refugee-led digital platform operating in Kakuma Refugee Camp, Turkana County, Kenya. Our mission is to empower refugees through storytelling, information sharing, and community connection.

By creating an account or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform constitutes acceptance of the updated Terms.

4. User Accounts

4.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

4.3 Age Requirement

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Platform.

4.4 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in harmful behavior, or for any other reason at our discretion.

5.1 Content Ownership

You retain ownership of any Content you post on the Platform. By posting Content, you grant Kakuma Blogging a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your Content on the Platform.

5.2 Content Standards

All Content posted on the Platform must:

• Be truthful and accurate to the best of your knowledge

• Respect the dignity and rights of others

• Not contain hate speech, discrimination, or harassment

• Not promote violence, illegal activities, or self-harm

• Not contain explicit sexual content

• Not infringe on the intellectual property rights of others

5.3 Content Moderation

We reserve the right to review, moderate, and remove any Content that violates these Terms or our Community Guidelines. We may also suspend or terminate users who repeatedly violate these standards.

• Scams and Fraud: Engaging in deceptive practices to defraud others

• Illegal Activities: Posting content or engaging in activities that violate Kenyan law

Users retain ownership of their Content. By posting Content, you grant us a license to use it as described in Section 5.1.

The Kakuma Blogging name, logo, and branding are trademarks of Kakuma Blogging. You may not use these without our prior written consent.

9. Job Postings and Opportunities

9.1 Job Listings

Job postings on the Platform are provided for informational purposes. We do not guarantee the accuracy, legitimacy, or availability of any job opportunity.

9.2 Applications

Users apply for jobs at their own risk. We are not responsible for the outcome of job applications or any agreements between users and employers.

9.3 Scam Prevention

We take reasonable steps to verify job postings but cannot guarantee that all listings are legitimate. Report suspicious postings to us immediately.

10. Payments and Monetization

10.1 Pro Packages

Kakuma Blogging offers paid Pro Packages with additional features. Payment terms, pricing, and features are specified on the Platform.

10.2 Refunds

Refunds for Pro Packages are available within 30 days of purchase, subject to our refund policy.

10.3 Fees and Charges

We may charge fees for certain services. All fees are clearly displayed on the Platform. We reserve the right to change fees with notice.

10.4 Payment Processing

Payments are processed through third-party payment gateways. We are not responsible for issues arising from third-party payment processors.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of these external sites. Your interactions with third parties are at your own risk.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's availability, reliability, or fitness for a particular purpose. Your use of the Platform is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Kakuma Blogging and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us, if any, in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless Kakuma Blogging and its team from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your infringement of any rights of others.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

If a dispute cannot be resolved informally, either party may pursue legal remedies in accordance with Kenyan law.

17. Termination

We may terminate or suspend your account at any time for violations of these Terms, without prior notice. Upon termination, your right to use the Platform ceases immediately.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Kakuma Blogging regarding your use of the Platform, superseding any prior agreements.
